written up for sexual assault charges. >> i will write up a report, and it will be up to them if they file charges on you for having sex with a minor. it does not bode well for you. do you know what that means? >> no. >> it's not a good thing that the person you had sex with is a cop's daughter. a cop's daughter is not someone you mess around with. >> reporter: the handcuffs came off, and the boy was never arrested, but what the officer did is now being criminally investigated. the boy's attorney says the officer was trying to scare him straight, but his method was wrong. >> in my opinion he committed kidnapping and false imprisonment. >> reporter: the officer through his lawyer said he was trying to scare the boy to change his behavior, but now the prosecutors are deciding if he abused hi authority. the -- his authority.

the family released the video to the san jose mercury because they can not believe what happened to their son. >> you think a civil lawsuit is coming? >> reporter: i don't know. it's hard to say, but when you hear and see what happened, it's shocking to see what the officer did. >> that's a little different. linda, thank you. >> okay. a san quinten prisoner is set to die in less than a week it would be the first death row prisoner in more than four years. he has a big decision to make first. the judge is ordering the condemned inmate to choose his posion. robert. >> reporter: albert brown has had almost 30 years to decide how the state would put him to death for the rape and murder of a 15-year-old girl. today a federal judge turned that upside down telling brown he has until 6:00 tomorrow night to decide how he will die, either a single lethal

shot or three different shots all designed to stop his heart. >> there are some reasons to argue that the one-drug method may be more humane. >> reporter: this law professor says if albert brown chooses the single shot, legally the state must comply. it's 25 times the drug given to patients to knock the patient out before surgery. >> the prisoner would be hypoxic and blue. in a short period of time, the heart will stop beating, and then the prisoner will die. >> reporter: the other option is a cocktail that the california previously used. the first knocked him out, the second paralyzed the person, and then the third stops the

heart. the judge halted -- halted the procedures in 2006 until they could have new regulations. the judge has not review the the new rules or chamber. even if he agrees to a single shot, the state officials could say the cocktail is the only way. >> if that's the case, the ruling is an automatic stay of execution. >> but brown was not next on the list to be executed. it was to be michael morales. no one is answering why the leap frog. albert brown has been on death row for 28 years. it was just recently that jerry brown was pushing for lethal ejection. could it be because of the governor's race? 61% of those poll in the bay area now support the death penalty. we just received word late

pepper spray prompted 30 people to evacuate the extended stay hotel this afternoon. crews searched the grounds but did not find any pepper spray or anything else. the hotel has been cleared, and people have been allowed back inside. police are calling it an even attack. >> they are looking for the people who terrified customers and customers and employees at -- customers and employees at an east bay store. two people went to the hospital. >> reporter: a cleanup crew neutralizing the pepper spray left on a safe. another worker is installing glass. employees and customers were left terrified and some in tears. three men entered the home consignment center and pepper sprayed three workers.
